1. Corporate Registered Capital Requirements

  • Thai Entities: A minimum paid-up registered capital of THB 2 Million is required per 1 foreign employee. Example: To sponsor 2 foreign employees, the corporation must maintain a minimum paid-up capital of THB 4 Million.
  • Foreign Entities Registered Abroad: A minimum inbound investment of THB 3 Million into Thailand is required per 1 foreign employee.
  • Special Exemption: If the foreign employee is legally married to a Thai national, the required registered capital is reduced by half to THB 1 Million (while the local-to-foreign employment ratio remains unchanged).

2. Local-to-Foreign Employment Ratio

  • Standard Ratio: The organization must maintain a ratio of 4 Thai employees to 1 foreign employee. Example: To employ 2 foreign professionals, the company must register at least 8 Thai employees.
  • IHQ & ITC Privileges: For businesses operating under International Headquarters (IHQ) or International Trading Center (ITC) status, a privileged ratio of 1:1 applies.

3. Business Viability & Corporate Standing

  • Corporations must present audited financial statements for the past 2 consecutive fiscal years, certified by an authorized auditor. This demonstrates financial stability, active business operations, and the legitimate necessity of employing foreign personnel.
